Terms and Conditions of Participation for the PLCnext Technology Instagram Giveaway December 2022

By participating in our PLCnext Technology Instagram Giveaway December 2022 starting on December 09, 2022 (hereinafter “Giveaway”), you declare your acceptance of the following Terms and Conditions of Participation:

1. Sponsor

(hereinafter referred to as “PHOENIX CONTACT”).

The Giveaway is in not affiliated with Instagram in any way and is in no way sponsored, supported, or organized by Instagram.

2. Eligible persons

Any natural persons at least 18 years of age are eligible for entry. Employees and legal representatives of the PHOENIX CONTACT Group, other representatives of the PHOENIX CONTACT Group, and relatives of the aforementioned persons are excluded. Furthermore, holders of public or European offices, or other persons specially obligated to public service are also ineligible to participate.

Entrants may be requested to provide proof of eligibility. If an entrant is not able to present this proof on request, then PHOENIX CONTACT is entitled to exclude them from the Giveaway and/or to retain the material prize.

3. Description of the Giveaway procedure; Participation; Material prize

A valid Instagram account is required for participation in the Giveaway.

The Giveaway begins at 16:00:00 (UTC+1) on December 09, 2022, and ends at 23:59:59 (UTC+1) on December 16, 2022 (hereinafter “Term”).

PHOENIX CONTACT is giving away one material prize-package in the form of:

In order to participate in the Giveaway, entrants

Participation in the Giveaway is not possible after the end of the Term. Every entrant may participate in the Giveaway only one time (regardless of the number of their comments under the Giveaway post). If the entrant chooses the extra-option, the entrant may participate in this Giveaway a second time. Participation in the Giveaway is free of charge.

The winner will receive a material prize in the form of aforementioned prizes. No cash payout of the prize is possible. The prize may not be exchanged or transferred.

4. Selection and announcement of the winner; Delivery of the prize

After the end of the Term of the Giveaway, one winner will be selected at random from all entrants who fulfill the Terms and Conditions of Participation.

The winner will be announced by PHOENIX CONTACT on the business day following the end of the Term in a story by the PHOENIX CONTACT Instagram account (PLCnext). The winning entrant consents to be announced as the winner in an Instagram story by PHOENIX CONTACT in which their Instagram account is named.

The winner must declare their acceptance of the prize to PHOENIX CONTACT (e.g., via Instagram private message) within seven days and inform PHOENIX CONTACT within this period of their first and last name as well as a postal address, telephone number and the desired size of the T-Shirt (male or female, S-XXL) for the delivery of the prize. If this does not occur, PHOENIX CONTACT is entitled to select another winner at random and award the prize to them. In this case, the new winner will be informed about the prize via a private Instagram message.

After the winner has declared their acceptance of the prize, PHOENIX CONTACT will deliver it to them within a period of four weeks. The material prize will be sent from the PHOENIX CONTACT registered office in Germany to the postal address provided by the winner. PHOENIX CONTACT will cover the delivery costs. Any subsequent costs related to the prize, such as potential customs fees incurred during international shipping or similar costs, will be borne by the winner.

5. Exclusion from participation in the Giveaway

PHOENIX CONTACT is entitled to exclude individual entrants from the Giveaway on justifiable grounds, such as violation of the Terms and Conditions of Participation, manipulation of the Giveaway and/or any other forms of manipulation by the respective entrant.

6. Modifications to the Terms and Conditions of Participation and discontinuation of the Giveaway

Furthermore, PHOENIX CONTACT reserves the right to end or interrupt the Giveaway at any time without explanation, in particular in cases where the planned Giveaway procedure would be disrupted or prevented, when PHOENIX CONTACT deems necessary, or in case of discrepancies or suspicion of technical manipulation.

No claims shall arise for entrants from modifications to the Terms and Conditions of Participation or discontinuation/interruption of the Giveaway.

7. Warranty and liability

PHOENIX CONTACT assumes no responsibility for data loss, in particular losses arising during data transmission or attributable to technical defects, to lost, damaged or late submissions, or to network, hardware, or software problems.

If the prize is found to be damaged or defective upon receiving, the winner must notify PHOENIX CONTACT accordingly in writing within seven days of receiving or the prize will be deemed accepted. The winner’s legal rights remained unaffected by the above.

PHOENIX CONTACT is liable exclusively for damages caused intentionally or by gross negligence or by culpable violation of an essential contractual obligation (e.g., an obligation serving as the necessary foundation for the proper execution of the contract and on whose compliance the entrant trusts or may trust) in a manner that jeopardizes the fulfillment of the purpose of the contract. The above limitations of liability and/or disclaimers of liability do not apply to damages arising from culpable injury to life, limb or health or from any other cases of mandatory legal liability, in particular the German Product Liability Act (“Produkthaftungsgesetz”).

8. Other provisions

The decision of PHOENIX CONTACT is final in all cases of dispute. Legal recourse is excluded.

The winner is responsible for the proper taxation of the prize in accordance with applicable tax regulations.

The platform terms and conditions and data protection rules of Instagram apply in parallel to these Terms and Conditions of Participation.

These Terms and Conditions of Participation are subject to the laws of the Federal Republic of Germany. If the entrant is a consumer, the legal regulations governing limitation of the choice of law and the applicability of mandatory regulations of the state where the entrant has their habitual residence as a consumer remain unaffected.
